Terms of use

Agreement and operator

These Terms of Use (Version 1.0, effective 2026-10-25) govern NewNclex (newnclex), an online NCLEX-RN and NCLEX-PN preparation service operated by NewNclex LLC, 10560 NW 27th Street, Unit 101, Doral, FL 33172. By affirmatively selecting the acceptance box at sign-up or checkout after being shown links to these Terms and the Privacy Notice, you agree to these Terms and acknowledge receipt of the Privacy Notice. This acknowledgment is not consent to optional personal-data processing. Under the Florida Uniform Electronic Transaction Act (Fla. Stat. § 668.50) and the federal E-SIGN Act (15 U.S.C. § 7001), electronic records and signatures cannot be denied legal effect solely because they are electronic; other requirements for an enforceable agreement still apply. We keep a record of the version you accepted and when. You may save or print these documents. Where a law requires a consumer disclosure in writing, we will obtain any required separate consent to electronic delivery and provide the required information about paper copies, withdrawal and access requirements before relying on electronic delivery. If we make a material change, we will notify you by email and by an in-app banner at least 30 days before it takes effect. If you do not agree to a material change, you may cancel before it takes effect and we will refund any prepaid, unused paid access time; we will obtain affirmative acceptance of materially revised Terms before applying them to you. Changes do not apply retroactively to accrued claims or purchases without your express agreement.

Educational service

We provide bilingual practice questions, simulated exams, study resources, progress tools and an optional AI tutor, subject to plan availability and usage limits. Preparation does not guarantee an exam result, licensure, employment or clinical competence, and we do not make any such promise. Availability and content may change. If we make a material change that reduces what you paid for, or stop offering the service, we will give you at least 30 days' notice by email and in-app banner (except where a security, legal or safety emergency requires faster action) and will refund prepaid access time that you have not used.

Accounts and eligibility

You must be at least 18 years old to use the service; it is not for minors. By creating an account you confirm that you are 18 or older, and if we learn that an account belongs to someone under 18 we will close it and delete its data. Provide accurate account information, keep your credentials private and use only your own account. Email/password sign-in, passkeys and multifactor authentication are supported, and Google sign-in is optional. Review and revoke unfamiliar sessions in Account > Security and report suspected misuse to help@newnclex.com.

Trial, plans and payments

NewNclex offers a free trial (currently three days, no payment card required) and these paid plans in US dollars: a monthly subscription at $29 per month, and one-time passes of 30 days for $59, 90 days for $109 and 180 days for $149. The price, duration, limits, discounts and any applicable taxes are shown to you before you confirm checkout; the price you see at checkout is the price you pay. Payments are processed by Stripe. Automatic renewal: the monthly subscription renews automatically every month at the price you expressly accept at checkout until you cancel. Before obtaining your billing information, we clearly disclose the recurring price, frequency and cancellation terms; we obtain your express informed consent before charging you. A price increase requires advance notice and your express agreement before we charge the higher price; otherwise we will end renewal at the end of your paid period. One-time passes give you the purchased access period only and do not renew. You can cancel at any time in Account > Billing or the billing portal, with no phone call or other special step required. Cancelling stops all future renewal charges; for an active subscription, cancellation takes effect at the end of the period you already paid for and you keep access until then (if the subscription is paused when you cancel, cancellation is immediate). You can pause and resume where offered: while paused you are not charged for the paused period, and resuming restarts paid billing and may change your billing date. You will receive a receipt or invoice for each charge and can view invoices in Account > Billing. If we offer a service contract with a term of 12 months or more that renews automatically for more than one month, we will email a clear renewal reminder 30 to 60 days before the cancellation deadline, explaining the renewal and how to find its terms and cancel, as required by Fla. Stat. § 501.165(2)(b). That reminder rule does not apply to our current monthly plan. Where Fla. Stat. § 501.165 applies, renewal terms must be conspicuous and cancellation must be available by the same manner and means as acceptance; a renewal provision violating subsection (2) is void and unenforceable. We will not charge you for any renewal you have cancelled in time.

Refunds and access

First-purchase refund: you may request a full refund within 7 days of your first purchase, as long as you have used fewer than 10% of the questions available in the purchased plan. After that, or if you have used 10% or more, payments are not refundable for time that has already elapsed on a pass or billing period, except where required by law or described in these Terms (for example, if we discontinue the service, or for a billing error or unauthorized charge, which we will correct). Cancelling a subscription stops future renewals at the end of the current period; it is not by itself a refund request. To request a refund, email help@newnclex.com from your account email with your purchase details; we will respond within 5 business days, and approved refunds are issued to the original payment method within 10 business days of approval (your bank may take longer to post them). A refund may end the related access, and we may close accounts that repeatedly abuse the refund policy. Nothing in this section limits rights you have under Florida or federal consumer-protection law.

AI disclosure

The AI tutor is an optional feature that uses third-party AI providers, including Anthropic Claude models through Amazon Bedrock, to generate automated study explanations. It can make mistakes. Our customer support is assisted by an AI support agent (Grok, provided by xAI) that reads support tickets and complaints and may reply automatically; you are dealing with an AI, not necessarily a person. Any matter involving money, refunds or changes to your account is escalated to a human. You can ask for human review of any AI response or support decision by emailing help@newnclex.com. Do not submit real patient information, confidential clinical records or secrets. AI output is educational and must not guide patient care.

Acceptable use and suspension

Use the service lawfully for your own study. Do not share or sell access, scrape or redistribute question banks, upload material you lack rights to use, impersonate others, harass people, attempt unauthorized access, bypass security or usage limits, manipulate results, or introduce malicious code. Do not submit real patient data or seek unreleased exam questions. We may suspend or terminate an account that violates these Terms. Except where urgent security or legal reasons require immediate action, we will first email you the reason and give you 7 days to respond. You can appeal any suspension or termination by emailing help@newnclex.com, and a person will review it within 10 business days. If we terminate your account for a reason other than your violation of these Terms, we will refund prepaid access time you have not used.

Original content and intellectual property

The platform is built around original questions, explanations, translations and software; it does not license official exam questions to you. Subject to these Terms and your plan, you receive a limited, personal, non-transferable right to use the materials for study. Ownership remains with NewNclex LLC or its licensors. You keep ownership of what you submit (such as notes and support messages) and give us only a limited, non-exclusive license to host, process and display it as needed to provide the service to you; any feedback you give us may be used by us without obligation to you. Copyright complaints (17 U.S.C. § 512): our designated agent is NewNclex LLC, at help@newnclex.com (mailing address 10560 NW 27th Street, Unit 101, Doral, FL 33172). A notice must identify the copyrighted work, the material you claim infringes and where it appears, your contact details, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that the notice is accurate and that you are the owner or authorized to act for the owner, with your signature. We will act expeditiously on valid notices and promptly notify the person whose material is removed. A counter-notice must include your signature, the removed material and its former location, a statement under penalty of perjury that removal resulted from mistake or misidentification, your name, address and phone number, and consent to the federal district court for your address (or, if outside the United States, any district where the provider may be found), and acceptance of service from the complainant or its agent. We will promptly forward a valid counter-notice to the complainant and restore the material 10 to 14 business days after receipt unless our agent first receives notice that the complainant has filed a court action to restrain the alleged infringement. We terminate repeat infringers in appropriate circumstances. Designated-agent contact details, including a telephone number, must be publicly available and registered with the Copyright Office before we claim the applicable safe harbor.

No medical advice; no affiliation

Materials, simulated scores, readiness estimates and AI responses are study aids, not medical advice, diagnosis, treatment or official exam results. Consult qualified professionals and current authoritative guidance for clinical decisions. NewNclex is independent and is not affiliated with, sponsored by or endorsed by NCSBN or Pearson VUE. NCLEX, NCLEX-RN and NCLEX-PN are marks of the National Council of State Boards of Nursing, used here only to describe the exam our content helps you prepare for.

Warranties and limitation of liability

To the extent permitted by law, the service is provided "as is" and "as available," without a guarantee of uninterrupted or error-free access or of any particular educational outcome, and we disclaim implied warranties to the extent the law allows. To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose or $100. These warranty exclusions, damage exclusions and liability cap do not apply to our negligence (including gross negligence), fraud, willful or intentional misconduct, personal injury or death, or any liability that cannot lawfully be limited or waived, and they do not limit your rights under the Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. ch. 501, part II) or other non-waivable consumer protections. You are not required to indemnify us for our own negligence or misconduct. Some laws do not allow certain limits, so they apply to you only to the extent permitted.

Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. You may bring a dispute in any court with jurisdiction and proper venue under applicable law, including an eligible small-claims court. You and we consent to the non-exclusive jurisdiction of the appropriate Florida courts; this does not create federal subject-matter jurisdiction or prevent you from using another legally available forum. The Florida choice of law does not deprive consumers elsewhere of mandatory protections that apply to them. These Terms contain no mandatory arbitration clause and no class-action waiver, and nothing here limits the time you have to bring a claim under Florida law or any right you have to seek relief from a court or from the Florida Attorney General or other regulator. Before filing a claim we encourage you to email help@newnclex.com so we can try to resolve the matter.
